1. Articles of Faith

Every church (or ministry) wishing to register an account with churchmedia.space must adhere to the following Articles of Faith:

1. The divine plenary verbal inspiration, infallibility, and absolute authority of the Old and New Testaments as the Word of God.
2. There is one living and true God, eternally existent in three Persons: Father, Son, and Holy Spirit.
3. The deity of Christ, His virgin birth, His sinless life, His miracles, His vicarious and atoning death through His shed blood, His bodily resurrection, His ascension to the right hand of God, and His visible and personal return in power and glory.
4. The personality of God the Holy Spirit, and the absolute necessity of His work in Regeneration and Sanctification, and His Infilling of the indwelt believer for power to live and witness for Christ.
5. Salvation is by grace through faith in Christ alone without the addition of human works.
6. The resurrection of both the saved and the lost: they who are saved unto the resurrection of life, and they who are lost unto the resurrection of damnation.
7. churchmedia.space is not open to the dissemination of such distinctive Charismatic and Pentecostalist views as extra-Scriptural revelations, tongues, healing, women pastors/preachers/elders, etc.

We reserve the right to remove any sermon, church, or organization that we feel is not in accordance with these Articles. All such decisions will be at the sole discretion of churchmedia.space.

Please note that churchmedia.space is not an association, organization, or denomination. Ecclesiastical fellowship is not necessarily implied by becoming a member. churchmedia.space is a privately-owned and operated site that seeks to promote the "Fundamentals of the Faith".

We reserve the right to reject membership at any time at our sole discretion.

2. Privacy

Your privacy rights are set forth in our Privacy Policy, which forms a part of this Agreement.

3. Membership

REGISTRATION: To fully use the churchmedia.space, you must register an account by providing a username, account holder's name, church name, password, and valid email address. You must provide complete and accurate registration information to churchmedia.space and notify us if your information changes. The person whose email address is associated with the account must have the authority to bind the entity to this Agreement.

USERNAME: We encourage you to use an acronym for your church. You may not use a name that violates any third party right.

ACCOUNT SECURITY: You are responsible for all activity that occurs under your account, including any activity by unauthorized users. You must not allow others to use your account. You must safeguard the confidentiality of your password. If you are using a computer that others have access to, you must log out of your account after using churchmedia.space. If you become aware of an unauthorized access to your account, you must change your password and notify us immediately at support[at]sermon[dot]fm.

4. Subscriptions and Pricing

Please see our sign up page for current features and pricing. Features and prices are subject to change. We may also offer add-on features and packages.

CANCELATION AND REFUNDS: churchmedia.space is free for a trial period of thirty (30) days upon registration. We will attempt to charge the card you have on file at the beginning of each period (monthly) following your thirty (30) day trial period. You may delete your account at any time. Deleting your account will terminate your subscription. All charges are final and all fees paid are non-refundable, even if your account is terminated before the end of your current subscription period. If your account is terminated due to your breach of this Agreement, you will not be refunded. If you have questions, please contact us.

FAILED PAYMENTS: We will attempt to charge the card you have on file at the beginning of each period (monthly) following your thirty (30) day trial period. If we are unable to process the payment, we will send you up to 3 warnings. If you do not take action to provide accurate billing information, we will delete your account and terminate your subscription.

5. Use of Third Party Media

churchmedia.space allows you to embed content from third party sites, such as Vimeo, YouTube, Wistia, SoundCloud, and MixCloud, to your sermon gallery. It is your sole responsibility to understand and comply with the terms of agreement between you and any third party site. It is your sole responsibility to use these third party sites, their content and resources in accordance with their terms. churchmedia.space makes no representations or warranties that any third party site will continue service to you or churchmedia.space. churchmedia.space is not responsible for the actions, content, information, or data of third parties, and you release us, our directors, officers, employees, and agents from any claims and damages, known and unknown, arising out of or in any way connected with any claim you have against any such third parties. churchmedia.space is not responsible for any breach of terms between you and any third party, and any subsequent action by the third party against you, even if the breach arises through your use of churchmedia.space, and you release us, our directors, officers, employees, and agents from any claims and damages, known and unknown, arising out of any breach of terms between you and a third party.

6. Term and Termination; Account Deletion

TERM: This Agreement begins on the date you first use churchmedia.space and continues as long as you have an account with us.

ACCOUNT DELETION: You may delete your account at any time. Accounts may be deleted from churchmedia.space if they remain inactive for a continuous period of at least six (6) months.

TERMINATION FOR BREACH: churchmedia.space may suspend, disable, or delete your account (or any part thereof) or block or remove any content you submitted if churchmedia.space determines that you have violated any provision of this Agreement or that your conduct or content would tend to damage churchmedia.space's reputation and goodwill. If churchmedia.space deletes your account for the foregoing reasons, you may not re-register for churchmedia.space. churchmedia.space may block your email address and Internet protocol address to prevent further registration.

EFFECT OF TERMINATION/ACCOUNT DELETION: In the event of account deletion for any reason, content that you submitted may no longer be available. churchmedia.space shall not be responsible for the loss of such content.

7. Your Representations and Warranties

For each piece of content that you submit, you represent and warrant that: (i) you have the right to submit the content to churchmedia.space; (ii) churchmedia.space will not need to obtain licenses from any third party or pay royalties to any third party; (iii) the content does not infringe any third party's rights, including intellectual property rights and privacy rights; and (iv) the content complies with this Agreement and all applicable laws.

8. Indemnification

You will indemnify, defend, and hold harmless churchmedia.space and its affiliates, directors, officers, employees, and agents, from and against all third party actions that: (i) arise from your activities on churchmedia.space; (ii) assert a violation by you of any term of this Agreement; or (iii) assert that any content you submitted to churchmedia.space violates any law or infringes any third party right, including any intellectual property or privacy right.

9. Third Party Copyrights and Other Rights

churchmedia.space respects the intellectual property rights of others. If you believe that your copyright has been infringed, please send us a notice at support[at]sermon[dot]fm

10. Disclaimers

churchmedia.space reserves the right to modify churchmedia.space's features and prices. churchmedia.space does not guarantee that any content available on churchmedia.space complies with this Agreement or is suitable for all users.

churchmedia.space is provided on an "as is" and "as available" basis. You therefore use churchmedia.space at your own risk. churchmedia.space expressly disclaims any and all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any other warranty that might arise under any law. Without limiting the foregoing, churchmedia.space makes no representations or warranties:

1. That churchmedia.space will be permitted in your jurisdiction;
2. That churchmedia.space will be uninterrupted or error-free;
3. Concerning any content submitted by any member;
4. Concerning your relationship with third party content providers, even if embedded or linked to from churchmedia.space
5. Concerning any third party's use of content that you submit;
6. That any content you submit will be made available on churchmedia.space or will be stored by churchmedia.space;
7. That churchmedia.space will meet your business or professional needs;
8. That churchmedia.space will continue to support any particular feature; or
9. Concerning sites and resources outside of churchmedia.space, even if embedded or linked to from churchmedia.space.

To the extent any disclaimer or limitation of liability does not apply, all applicable express, implied, and statutory warranties will be limited in duration to a period of thirty (30) days after the date on which you first used churchmedia.space, and no warranties shall apply after such period.

11. Limitation of Liability

To the fullest extent permitted by law: (i) churchmedia.space shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses; and (ii) churchmedia.space's total liability to you shall not exceed the amounts paid by you to churchmedia.space over the three (3) months preceding your claim(s).

12. General Provisions

Australian law will govern this Agreement, as well as any claim, cause of action or dispute that might arise between you and churchmedia.space, without regard to conflict of law provisions. You agree that in the event of any dispute related to these Terms, the Site, Content, churchmedia.space or otherwise in connection with the subject matter of the relationship established by these Terms or your participation as a Member, the state and federal courts located in Canberra, Australian Capital Territory will have exclusive jurisdiction, and you hereby irrevocably submit to the exclusive jurisdiction of such courts. These Terms will not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly disclaimed.

SUCCESSORS; ASSIGNMENT; NO THIRD PARTY BENEFICIARIES: This Agreement is binding upon and shall inure to the benefit of both parties and their respective successors, heirs, executors, administrators, personal representatives, and permitted assigns. You may not assign this Agreement without churchmedia.space's prior written consent. No third party shall have any rights hereunder.

NOTICES: You consent to receive all communications including notices, agreements, disclosures, or other information from churchmedia.space electronically. churchmedia.space may provide all such communications by email. For support-related inquiries, you may contact us at support[at]sermon[dot]fm. You may send notices of a legal nature to churchmedia.space at support[at]sermon[dot]fm

Nothing herein shall limit churchmedia.space's right to object to subpoenas, claims, or other demands.

MODIFICATION: This Agreement may not be modified except by a revised Terms of Service posted by churchmedia.space on the churchmedia.space Site or a written amendment signed by an authorized representative of churchmedia.space. A revised Terms of Service will be effective as of the date it is posted on the churchmedia.space Site.

This Agreement constitutes the entire understanding between churchmedia.space and you concerning the subject matter hereof and supersedes all prior agreements and understandings regarding the same.

YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS, UNDERSTAND THEM, AND HAD AN OPPORTUNITY TO SEEK INDEPENDENT LEGAL ADVICE PRIOR TO AGREEING TO THEM.
